Former Secretary And Trustee Of Temple Charged For Acting In The Capacity Of A Governing Board Member Of A Charity Whilst Disqualified

The former Secretary and Trustee of Sri Veeramakaliamman Temple was charged in court on 24 June 2020 for acting in the capacity of a governing board member of the Temple whilst being disqualified under the Charities Act.

The 64-year-old man was disqualified after he was convicted of offences under the Employment of Foreign Manpower Act on 9 May 2017. Between 9 May 2017 and 30 April 2018, the man continued to be involved in his former role in the temple while under disqualification.

Under the Charities Act, persons who have previously been convicted of offences involving elements of dishonesty (including fraud, corruption, bribery and deception) are disqualified from acting in the capacity of a governing board member, key officer or trustee of any charity. This ensures that only fit and proper persons can take part in the general control and management of the administration of charities, to safeguard charities’ assets.

The Charities Act was amended on 1 April 2018. After the amendments, the offence of acting in a capacity that the person is disqualified from acting in is punishable with a fine not exceeding $10,000 or imprisonment for a term not exceeding 3 years or to both.
