Three men, aged 25, 26 and 38, were charged in court on 21 April 2023 for their suspected involvement in a fraudulent insurance claim for property damages from a road traffic accident.

The Commercial Affairs Department commenced investigations against the trio after receiving a report of a suspected fraudulent property damage claim on 4 October 2021.

The trio had allegedly conspired for the 26-year-old man to file a false insurance claim purporting to be the driver of the vehicle at the time of the accident, as the 25-year-old man, who was the actual driver, did not have the requisite insurance coverage.

The charges against the trio are as follows:

  1. The 25-year-old man was charged for:

    1. One count of engaging in a conspiracy to cheat and induce the delivery of property under Section 420 read with Section 116(1) of the Penal Code; and

    2. One count of using a motor vehicle without being insured against third-party risks, under Section 3(1)(a), punishable under Section 3(2) and Section 3(3), of the of the Motor Vehicles (Third-Party Risks and Compensation) Act.

  2. The 26-year-old man was charged for:

    1. One count of engaging in a conspiracy to cheat and induce the delivery of property under Section 420 read with Section 116(1) of the Penal Code.

  3. The 38-year-old man was charged for:

    1. One count of engaging in a conspiracy to cheat and induce the delivery of property under Section 420 read with Section 116(1) of the Penal Code; and

    2. One count of permitting the use of a motor vehicle without the requisite insurance against third-party risks under Section 3(1)(a), punishable under Section 3(2) and Section 3(3), of the Motor Vehicles (Third-Party Risks and Compensation) Act.

Offenders convicted under Section 420 of the Penal Code shall be punished with up to 10 years’ imprisonment and shall also be liable to fine. Using or permitting the use of a motor vehicle without the requisite insurance against third-party risks under Section 3(1)(a) of the Motor Vehicles (Third-Party Risks and Compensation) Act is punishable with imprisonment for a term not exceeding three months, a fine not exceeding $1,000, or both. A person convicted of an offence under this section shall, in the absence of special reasons, be disqualified from holding or obtaining a driving license under the Road Traffic Act for a period of 12 months from the date of the conviction.

The Police would like to remind members of the public of the risks of driving without insurance coverage. Drivers should ensure they are adequately covered to avoid heavy expenses incurred from injuries or damages caused to the driver, vehicle and others. The Police takes a serious view of motor insurance fraud and will deal with perpetrators in accordance with the law.
