Two men, aged 66 and 48, were charged in court today for offences relating to cheating and forgery under Sections 420 and 468 of the Penal Code.
At the material time, the 66-year-old man and 48-year-old man were respectively:
- a director of the then-term contractor engaged by the Ministry of National Development (“MND”) for mechanical and electrical maintenance works; and
- a director of a subcontractor, engaged by the then-term contractor, for works undertaken in MND building.
The duo is accused of engaging in a criminal conspiracy to cheat MND, by dishonestly concealing from MND that the then-term contractor had a discount arrangement with the subcontractor, in respect of certain works performed for MND. MND was allegedly deceived into paying approximately $260,000 to the then-term contractor for the impugned works between 2016 and 2018 and was allegedly unaware that the then-term contractor had been paying discounted prices to the subcontractor. It was further alleged that the term contract required the quotations from the subcontractors, which were furnished to MND, to be net of all discounts; contrary to this requirement, the discount arrangement was dishonestly concealed from MND.
The 48-year-old man also allegedly conspired with his staff to forge 67 quotations in the name of other subcontractors, intending that the alleged forged quotations be used for the purpose of cheating MND.
The offence of cheating under Section 420 of the Penal Code carries an imprisonment term of up to 10 years and a fine. The offence of forgery for the purpose of cheating under Section 468 of the Penal Code carries an imprisonment term of up to 10 years and a fine.
